1. Agreement to Terms
By accessing our website, requesting a quote, scheduling a service, or using any services provided by Straight Up Junk Removal LLC ("Company," "we," "us," or "our"), you agree to be bound by these Terms & Conditions. If you do not agree, please do not use our services.
2. Services Provided
Straight Up Junk Removal LLC provides residential and commercial junk removal, hauling, and disposal services in San Antonio, TX and surrounding areas. Services include, but are not limited to:
Furniture and appliance removal
Construction and yard debris removal
Estate and garage cleanouts
Office and commercial cleanouts
Mattress, electronics, and bulk item disposal
We reserve the right to refuse any job at our sole discretion, including items we are unable to legally or safely transport.
3. Pricing & Estimates
All quotes and estimates are based on the volume, weight, and type of items to be removed.
Estimates provided online, by phone, or via text are approximations and subject to change upon on-site assessment.
Final pricing is confirmed on-site before work begins. You have the right to decline service at that time with no obligation.
Prices are subject to change without notice for future bookings.
4. Payment Terms
Payment is due in full upon completion of services, unless otherwise agreed in writing.
We accept cash, credit/debit cards, and other payment methods as posted on our website.
For large or commercial jobs, a deposit may be required to secure your appointment.
Returned checks or failed payments are subject to a $35 returned payment fee.
Unpaid balances may be referred to collections and may accrue interest at the maximum rate permitted by Texas law.
5. Scheduling & Cancellations
Appointments are scheduled based on availability and are not guaranteed until confirmed by our team.
Cancellations must be made at least 24 hours in advance to avoid a cancellation fee.
Late cancellations (less than 24 hours notice) or no-shows may be charged a cancellation/trip fee of up to $75.
We will make every effort to arrive within the scheduled time window; however, arrival times may vary due to factors beyond our control.
6. Customer Responsibilities
You agree to:
Ensure all items for removal are accessible and ready upon our arrival.
Disclose any hazardous materials, biohazards, chemicals, or regulated items before the appointment. We cannot remove these items.
Ensure that our team has safe, unobstructed access to the property.
Obtain any necessary HOA or landlord permissions before scheduling service on a property you do not own.
7. Prohibited Items
We are unable to remove the following items:
Hazardous waste (paints, chemicals, solvents, pesticides)
Asbestos-containing materials
Medical or biohazardous waste
Gasoline, propane tanks, or other flammables
Any item prohibited by federal, state, or local law
Attempting to include prohibited items without disclosure may result in additional fees and/or cancellation of service.
8. Property Damage
Our team takes great care to avoid damage to your property.
Any pre-existing damage should be noted before work begins.
Claims for damages must be reported within 24 hours of service completion.
Our liability for any damage is limited to the cost of the service rendered.
We are not liable for damage resulting from inaccessible areas, fragile items not disclosed, or pre-existing structural conditions.
9. Disposal & Recycling
We are committed to responsible disposal. Where possible, we donate usable items to local charities and recycle qualifying materials.
We make no guarantees regarding the final disposition of specific items once removed.
Disposal is conducted in compliance with applicable local, state, and federal regulations.
10. Limitation of Liability
To the fullest extent permitted by law, Straight Up Junk Removal LLC shall not be liable for any:
Indirect, incidental, or consequential damages
Loss of profits or revenue
Damage to items not disclosed prior to service
Delays caused by weather, traffic, or other circumstances beyond our control
Our total liability for any claim arising from our services shall not exceed the total amount paid by you for the specific service giving rise to the claim.
11. Indemnification
You agree to indemnify and hold harmless Straight Up Junk Removal LLC, its owner, employees, and agents from and against any claims, damages, losses, or expenses (including attorney's fees) arising out of your use of our services, your violation of these Terms, or your violation of any applicable law or third-party rights.
12. Warranty Disclaimer
Services are provided "as is" and "as available." We make no warranties, express or implied, regarding the results of our services beyond what is stated in writing at the time of booking.
13. Governing Law & Dispute Resolution
These Terms shall be governed by the laws of the State of Texas, without regard to conflict of law principles. Any disputes arising from these Terms or our services shall be resolved in the appropriate courts of Bexar County, Texas.
We encourage you to contact us first to resolve any issue informally before pursuing legal action.
14. SMS & Marketing Communications
By providing your phone number and requesting services, you agree to receive transactional and service-related SMS messages from Straight Up Junk Removal LLC. Promotional messages require your explicit opt-in consent. You may opt out at any time by replying STOP.
15. Changes to These Terms
We reserve the right to modify these Terms & Conditions at any time. Updated terms will be posted on our website with a revised effective date. Continued use of our services after changes are posted constitutes your acceptance of the revised terms.
16. Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
